Provider and agreement
These terms are between you and the individual developer Yu Lu. Tembilo is for users aged 16 and over. Age confirmation is an immediate self-declaration without collecting exact age or date of birth, not independent identity verification. Read these terms, the privacy policy, food data disclaimer and data licences before use. If you disagree, do not use the app.
Users aged 16–17 have the same self-set limits and logging flow. Help with understanding is not legal representative authority; obtain appropriate authority where someone must lawfully consent on your behalf. These terms do not assert full contractual capacity for every 16–17-year-old or automatically authorise an adult to access their private records. Food data may contain alcohol entries. The product age limit does not establish the local legal age to buy or consume alcohol; the app does not sell alcohol or encourage drinking.

App features and self-set limits
Tembilo is a food diary with daily limits you set yourself. It provides local AFCD/USDA food lookup, manual entry, recent items and favourites, portion checking, energy and macronutrient logging, self-set limits, history, optional online OFF barcode lookup, CSV/JSON export and deletion. The initial Australian release offers food templates only on iPhone and iPad, in English and Simplified Chinese. It is free with no in-app purchases, account, advertising, tracking, analytics SDK, large language model or developer-operated app server. Any future paid service needs separate, clearly disclosed terms and your agreement; these terms do not enrol you in a future subscription.
You can choose favourites to make a food booklet, title it and reorder its members. Browsing a booklet does not log a meal, and there is no collection target. Today's summary only presents existing records for that day; it can be skipped and has no streaks. The initial release offers one card design and no purchases.
All lower and upper limits — for energy, nutrients, vitamins, minerals or supplement ingredients — are entered by you and are not recommended intakes, doses or safety thresholds. You can log without limits and continue logging above them. Demonstration values do not automatically become your limits. Progress and colours only compare values, without rating diet quality. Daily totals start a new period at local midnight on your device without deleting previous records. Energy defaults to kJ, with a kcal option.
Nutrient bars on food cards use your corresponding daily target as their display reference when set. Otherwise, they use FSANZ food-labelling reference amounts (protein 50 g, carbohydrate 310 g and fat 70 g). These amounts do not automatically become your limits and are not personal intake recommendations or safety standards.
Appropriate use and reference values
Use the app lawfully without interfering with it or misusing third-party APIs. Check entries, portions, units, current packaging and sources. Composition and portion conversions are reference values; missing values do not mean zero. The app does not generate limits from personal physiological information, provide dietary, nutrition or medical advice, or assess allergy safety. Original source limitations and licence notices continue to apply.
Your records and external services
You retain rights in your own entries; these terms do not grant the developer ownership of your diary. Records remain locally under the privacy policy and can be exported or deleted by you. Deletion, device loss or damage can permanently remove records; the developer provides no cloud recovery. Shared files, existing system backups and third-party records need separate handling and cannot be recalled by local deletion. We do not promise uninterrupted, error-free operation or complete food coverage.
Barcode lookup is chosen by you and depends on Open Food Facts and internet access. It may be unavailable or have missing data. OFF's terms and privacy policy govern its service. External links do not imply endorsement. Manual entry and the built-in library remain available when lookup fails. Saved entries and favourites are local source snapshots without automatic refresh; reuse and exports retain attribution and licence notices.
Software and food-data rights
Software, branding and third-party material belong to their respective rights holders. The software licence appears below; food data is separately licensed.
The AFCD Release 3 subset and our adaptations are provided under the FSANZ Data User Licence Agreement. The app's Food sources and licences area offers free, account-free export of the original afcd.json and LICENSE-AFCD.md, separate from private record exports. Contact [email protected] if a copy is unavailable. AFCD and USDA datasets remain separate; no AUSNUT data is included.
USDA FoodData Central is provided under CC0 1.0; OFF database and individual contents under ODbL 1.0 and DbCL 1.0 respectively. Software-use restrictions do not cover data rights separately granted by those licences. Redistribution must preserve original copyright, change, licence and limitation notices and comply with the relevant licence. This statement does not amend Apple or third-party terms or imply FSANZ approval of store distribution or technical measures. The app does not automatically publish your private records to meet data-licensing obligations.
Consumer guarantees and liability
These terms and the disclaimer do not exclude, restrict or modify non-excludable guarantees, liability or remedies under applicable law, including applicable Australian Consumer Law rights. Free access does not remove those rights. Where applicable, statutory remedies may include rectification, re-supply and compensation for reasonably foreseeable loss, depending on the law and facts. Reference data and self-set limits do not remove legal duties or express commitments. These terms impose no additional general liability cap or blanket exclusion of indirect loss. Contacting support is not a prerequisite to statutory rights.
Changes, stopping use and disputes
You may stop using the app, export or delete records and uninstall. The developer may adjust features for fixes, safety, legal compliance or third-party changes. Before a planned change materially affects record access or export, reasonable advance notice and an export opportunity must be provided. Urgent safety or legal requirements may require immediate action with an explanation as soon as practicable. Changes do not retrospectively remove accrued rights, authorise new processing or alter granted data licences. Declining new terms does not permit the developer to remotely delete local records.
Website revisions show the actual update date and the app provides corresponding offline text. Material changes introducing new data handling must be explained beforehand; processing requiring consent must not start before it is obtained. A revision or update does not itself constitute consent.
The laws of Victoria, Australia govern these terms, subject to mandatory consumer protection where you live. Access to competent courts, tribunals or regulators is not restricted. If a provision is unenforceable, the rest continues where lawful. English and Chinese versions are intended to have the same meaning; report discrepancies, and mandatory rights prevail in either version.
Apple application licence
- Parties. This application licence agreement is between you and the individual developer Yu Lu, not Apple. The developer, not Apple, is solely responsible for Tembilo and its content. Its app usage rules must not conflict with the applicable Apple Media Services Terms and Conditions or Volume Content Terms.
- Software licence. The developer grants you a non-transferable licence to use Tembilo on Apple-branded devices you own or control as permitted by Apple's applicable usage rules. Access, acquisition and use by associated accounts through Family Sharing, volume purchasing or Legacy Contacts, where permitted by those rules, are not excluded. This software licence does not restrict rights granted under the separate data licences described in the Software and food-data rights section.
- Maintenance and support. The developer is responsible for maintenance and support specified in this agreement or required by applicable law. Apple has no obligation to provide maintenance or support for the app. Contact [email protected] for support.
- Warranties and remedies. The developer is responsible for express or legally implied product warranties that have not been effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund its purchase price. To the maximum extent permitted by applicable law, Apple has no other warranty obligation for the app; other claims, losses, liabilities, damages, costs or expenses arising from a warranty failure are the developer's responsibility under applicable law. The initial release being free, with no purchase price to refund, does not remove the developer's other legal obligations or impose a zero-dollar liability cap.
- Product claims. The developer, rather than Apple, is responsible for addressing your or a third party's claims relating to the app or its possession or use, including product liability and legal or regulatory compliance claims, and claims under consumer protection, privacy or similar legislation. This agreement does not limit the developer's liability to you beyond what applicable law permits.
- Intellectual property claims. If a third party claims that the app or your possession or use of it infringes intellectual property rights, the developer, rather than Apple, is responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You represent and warrant that you are not located in a region subject to a US Government embargo or designated by that government as supporting terrorism, and that you are not on a US Government list of prohibited or restricted parties.
- Developer contact. Developer: Yu Lu; address: Melbourne, Victoria, Australia (a full postal address for legal notices is available on request by email); email: [email protected]. Telephone: not provided; please contact us by email. Direct questions, complaints and claims about the app to these contacts.
- Third-party terms. When using the app, comply with applicable third-party agreements, including relevant service terms and separately licensed food-data terms. This does not remove non-excludable legal rights or require publication of your private diary.
- Third-party beneficiaries. You and the developer acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this application licence agreement. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce it against you as a third-party beneficiary.
